BRIDGETON Following an unsuccessful lawsuit that challenged her employer's disciplinary action, Cumberland County Prosecutor's Office Administrative Secretary Francine Hovermann has filed a second lawsuit against the county and the Prosecutor's Office, seeking a reversal of her 2013 demotion.The 40 year employee was reprimanded last year for omitting facts during an internal affairs investigation into complaints from a co worker that she gossiped about a personal trip she and County Prosecutor Jennifer Webb McRae took to an adult boutique store in 2013.Separately, she was demoted for having reviewed drafts of confidential letters about the investigation into her conduct, and then not reporting those instances to her superiors.A disciplinary hearing spread over five days in August and September ended with Cumberland County Personnel Director Craig Atkinson upholding Hovermann's reprimand.But the new suit, filed by Hovermann's attorney John P. Rowland last month, effectively asks for a Superior Court judge to order the county to dismiss all charges against Hovermann.The new suit seeks a reversal of her reprimand on the argument that the county lost testimonial evidence her attorney claims would be crucial to a higher court's review of the matter."The county's loss of the two days of hearing which were favorable to (Hovermann) unlawfully infringe upon her rights to have a meaningful de novo, on the record review by a higher court," the suit states.County solicitor Ted Baker said the county will move to dismiss the suit."The lawsuit is baseless," Baker said Thursday. "We don't think there's any legal merit to this whatsoever."Hovermann, a resident of Buena Borough, had been office manager for a succession of prosecutors.But in September 2013, she was demoted for having reviewed the drafts of confidential letters about her pending investigation into her conduct.The letters, given to Hovermann by confidential secretary Lillian Hernandez who was fired for sharing the documents were intended to eventually be given to Hovermann, her suit points out.In January, 2013, Hovermann and Webb McRae traveled to Philadelphia on their personal time to celebrate Hovermann's birthday.They ate dinner in the city and then stopped by a business owned and operated by Hovermann's son the Kink Shoppe, an upscale adult boutique store.Webb McRae purchased two vibrators, a fact that Hovermann later relayed to two co workers at the Prosecutor's Office Chief of Detectives William Johnson and legal secretary Mary Kaganzev.Webb McRae recused herself from the matter.Cuff and detective Jay Pennypacker interviewed Hovermann and she denied naming Webb McRae by name when she discussed the night out with her co workers.But, on the same day of that interview, she attempted to retract her initial false statements.Rowland, in both lawsuits, contends that Hovermann's privacy was nonetheless invaded by the investigation."The private discussion between Hovermann and Kaganzev while out to lunch did not violate any internal rule or regulation within the Cumberland County Prosecutor's Office," the suit said.He has since filed a whistleblower lawsuit against both the county and the Prosecutor's Office, alleging objections to the way investigations and internal affairs procedures were conducted.His suit specifically mentioned Hovermann's case.In response to her demotion, Hovermann filed suit late last year, and a trial court this year ordered a formal disciplinary hearing to be held in August and September to review her reprimand.In his testimony during the hearing, the suit states that Cuff acknowledged that the investigation had no relation to the workplace, and that Hovermann did not violate any rule or regulation by speaking with Kaganzev about the trip, saying the trip and subsequent gossip was personal and private in nature..相关的主题文章：
